What Is a Lauderdale Lakes Lady Bird Deed?

A Lauderdale Lakes Lady Bird Deed is the common name for a Florida enhanced life estate deed recorded on property in Broward County. It names the beneficiaries, called remaindermen, who receive the property automatically at your death, while reserving to you an enhanced life estate that leaves you in complete control while you are alive.

The enhancement is the part that matters. Under a traditional life estate deed you could not sell or mortgage without every named beneficiary signing, which for an older owner who may need to sell and move closer to family is a locked door at exactly the wrong moment. An enhanced life estate deed reserves the power to sell, convey, mortgage, lease and revoke without their consent.

The recording formalities come from Fla. Stat. §§ 689.01 and 695.03. The enhanced reservation itself is a creature of Florida practice and title custom rather than a statute written for it, which is exactly why what the document says matters so much.

Florida Has Three Probate Routes. Only Two Reach a House.

Families often arrive believing there is a simple, cheap way to handle a small estate in Florida. There is. It just does not apply to real property, and almost nobody discovers that until they need it.

1. Disposition without administration: personal property only

Fla. Stat. § 735.301 provides that no administration is required and no formal proceedings need be instituted upon the estate of a decedent leaving only personal property exempt from creditors, together with non-exempt personal property whose value does not exceed the sum of preferred funeral expenses and reasonable and necessary medical and hospital expenses of the last 60 days of the final illness.

Read the first clause again. Personal property. The procedure was built to let a family recover a small bank balance to pay for a funeral. A house is real property, and real property does not qualify for this route at any value. Not a $214,100 house, not a $50,000 house, not a mobile home on land you own.

2. Summary administration: available, but still a court case

Fla. Stat. § 735.201 allows summary administration where the value of the non-exempt estate does not exceed a statutory ceiling. Effective 1 July 2026, CS/SB 1500 raised that ceiling from $75,000 to $150,000, applying to decedents who die on or after that date.

Two things people get wrong here. First, protected homestead is exempt and is not counted toward the ceiling, so a home does not usually push an estate over the limit. Second, and less welcome, summary administration is still a court proceeding. There is a petition, there are notices, there is a judge. And where a homestead is involved, a separate petition and order determining homestead status is usually required before a title company will insure a sale.

3. Formal administration: the full case

Where summary administration is not available, the estate goes through formal administration with a personal representative, publication of notice to creditors, a claim period and the full sequence. This is what everyone pictures when they hear the word probate, and it is what a Lady Bird Deed exists to avoid for the home.

That last row is the whole argument for the deed in a market like this one. Not sophistication, not tax planning, just the removal of a court proceeding from a family that would feel its cost more than most.

The Two-Year Rule, and Homes Still in a Parent's Name

A recurring situation in older, modestly valued neighborhoods: a parent died some years ago, nobody opened a probate case because nobody could face the cost, and the family simply kept living in the house. The taxes get paid. The insurance gets paid. Nothing is recorded.

There is a genuinely useful provision here. Summary administration remains available at any estate value once more than two years have passed since the date of death, because the period for creditor claims has run. A family that waited is sometimes in a simpler position now than they would have been at the time.

What has usually grown harder is the record. Each year the home sits in a deceased owner's name, the picture gets more complicated:

  • More heirs to locate, some of whom have themselves died, adding another generation
  • Heirs living in other countries whose signatures are needed and hard to obtain
  • A title company that will not insure a sale or a refinance without a court order
  • An inability to borrow against the home, or to use it, because record title is wrong
  • Property tax and homestead exemption problems, because the exemption follows the owner

The relevance to a Lady Bird Deed is direct and worth stating plainly. A deed conveys only what you actually hold. If record title still stands in your late mother's name, a deed signed by you does not fix it, and recording one may make the record more confusing rather than less. The order is: sort out the title first, then put the deed in place so the next generation is not in the same position.

If this is your situation

  • Find the last recorded deed. The Broward County Official Records are searchable, and the answer is usually there in ten minutes.
  • Write down who has died and when. The two-year date matters, and so does the order of deaths.
  • List everyone who might have an interest, including the children of anyone who has died. This is the part that takes longest.
  • Do not record anything before you know what you hold. A quitclaim deed signed in good faith by someone who does not own the property clouds the title further.

Liens and Assessments Follow the Property

Any recorded lien travels with the property, and a Lady Bird Deed does not extinguish it. Association assessments, municipal utility liens, code enforcement liens and contractor claims of lien all remain attached to the land, and whoever receives the home receives the obligation with it.

A significant share of Lauderdale Lakes housing sits in condominium and villa associations, some of them long established. A beneficiary who inherits a unit inherits the assessment obligation that comes with it, and a beneficiary who cannot carry those costs is a beneficiary who will have to sell quickly. That is a conversation far better had while you are alive.

The practical step is small: check the record before the deed is drafted rather than after. It costs nothing, and finding a lien at a closing is considerably worse than finding it now.

Homestead Exemption, Save Our Homes and Spousal Rights

A properly drafted Lauderdale Lakes Lady Bird Deed should not disturb your homestead exemption or your Save Our Homes assessment cap during your lifetime. You retain the enhanced life estate, you remain in possession, and the Broward County Property Appraiser continues to treat you as the owner of record.

The cap does not pass to your beneficiaries. It resets on the change of ownership at death, the same as it would through probate or a trust. For an owner who has held the same home for thirty years, the assessed value may sit far below market, and the reset is a real number the next generation should see coming.

On the constitutional side, Article X, Section 4 of the Florida Constitution provides that a married owner cannot convey homestead without the spouse joining in the deed, whether or not the spouse is on title, and that homestead cannot be devised away from a surviving spouse or a minor child. These restrictions are tested at death rather than at signing. A married couple normally signs the Lady Bird Deed together, naming the beneficiaries who take after the second death.

Medicaid and Estate Recovery

Florida's Medicaid program is required by federal law to seek reimbursement from the estates of recipients aged 55 and over who received long-term care benefits, and the word doing all the work is estate. Florida defines it narrowly: recovery reaches assets passing through the probate estate. Florida has not adopted the expanded definition some states use.

Because a Lady Bird Deed moves the home outside probate, it is one of the standard tools for reducing estate recovery exposure on a Florida homestead. Recording it is not a transfer for the five-year look-back, because nothing leaves your control during your lifetime.

With 19.4% of residents aged 65 or older, and a home that for most owners here is the entire inheritance, this is not an abstract concern in Lauderdale Lakes. It is often the single strongest reason to record the deed.

The limits

  • The deed does not qualify anyone for Medicaid. Eligibility is a separate analysis.
  • The five-year look-back applies to transfers of non-homestead assets.
  • Protection depends on the home keeping homestead status and passing to heirs; a will directing the home to be sold undoes it.

Recording a Lauderdale Lakes Lady Bird Deed

Here is the Broward quirk worth knowing: the Clerk of Courts does not record deeds in Broward County. That function belongs to the county's Records, Taxes & Treasury Division. Sending a deed to the Clerk, as you would in most other Florida counties, sends it to the wrong office.

The recording counter is at the Broward County Governmental Center, 115 South Andrews Avenue, Room 114, Fort Lauderdale, Florida 33301, generally open 8:30 a.m. to 5:00 p.m. weekdays. Deeds may also be mailed or submitted through an approved e-recording provider, which returns the recorded instrument in a day or two.

Execution requirements

Florida requires a deed conveying an interest in real property to be signed in the presence of two subscribing witnesses and acknowledged before a notary public (Fla. Stat. §§ 689.01 and 695.03). Both witnesses must be present and must sign. Deeds signed at a hospital or care facility without proper witnessing fail this test regularly, and the failure surfaces at death when it can no longer be corrected.

Recording fees and documentary stamp tax

Recording charges are $10.00 for the first page, $8.50 for each additional page, and $1.00 per name indexed beyond four names. Broward applies the standard statewide documentary stamp rate of $0.70 per $100 of consideration on taxable deeds, unlike neighboring Miami-Dade.

Whether the tax applies to this deed at all was addressed in Technical Assistance Advisement 20B4-004 (October 16, 2020), in which the Florida Department of Revenue concluded that an enhanced life estate deed is not subject to documentary stamp tax, because no present beneficial interest transfers when the deed is signed. A Technical Assistance Advisement binds the Department only as to the taxpayer and facts presented. Where the property carries a mortgage, the analysis turns on whether there is consideration.

After a Death: What Your Family Actually Does

  1. Order certified death certificates

    From the Florida Department of Health. Order several: the property appraiser, the insurer, the association and any lender will each want one.

  2. Record one against the property

    Recorded in the Broward County Official Records, this publicly establishes that the life estate has ended and the named beneficiaries hold title.

  3. Provide an affidavit if a title company asks

    On a sale or refinance, a title underwriter commonly wants an affidavit confirming identity, continuous marital status, and that the deed was never revoked.

  4. Notify the insurer and any association

    Both need to know who owns and occupies the home. Vacant property has different coverage requirements.

  5. Apply for their own homestead exemption

    Your exemption does not transfer. A beneficiary who moves in applies in their own name with the Broward County Property Appraiser.

What is not on that list: a petition, a filing fee, a personal representative, publication of notice to creditors, a creditor claim period, or an order determining homestead. That is the entire point, and in a market like this one it is worth more than it sounds.
